Nelly Baghdasaryan, Judge on the case of substitution of arrest as measure of restraint against RA second President Robert Kocharyan with pledge, satisfied the motion to challenge the judge filed by the prosecutors and the investigator,

The decision of the court will be provided to Robert Kocharyan’s defense group today.

Based on the verdict, the court found that Robert Kocharyan and former head of the March 1 case Vahagn Harutyunyan were charged within the scope of the same case, and since Judge Baghdasaryan had previously withdrawn from Vahagn Harutyunyan’s case, thus she had to withdraw from Robert Kocharyan’s  case.

At the same time, the decision states that the existence of these circumstances does not hinder the  impartiality of the presiding judge in the case, but regarding to the fact that there already is reasonable suspicion in the impartiality of the presiding judge (only the prosecutors and investigators have expressed doubts) in the case of existence of such circumstances, any decision (satisfaction or refusal) of an arbitral tribunal may be questioned by an impartial observer who may have doubts about the impartiality of the judge .

Judge Baghdasaryan also found that her withdrawal and transfer of the motion to another judge’s proceedings cannot lead to any negative consequences.
