The night of April 2nd Azerbaijan attacked began an armed conflict against NKR which resulting in numerous casualties that included peaceful civilians such as 12 year old Vaghinak.
As to what can be done from a legal standpoint with regards to the war crimes committed by Azerbaijan, Iravaban.net spoke with Adviser to the Chairman of the Constitutional Court, International Law Expert, Aram Vardevanyan.
“I find that those actions of the armed forces of Azerbaijan should have been considered within the jurisdiction of the International Criminal Court. I think all of the evidence, which was made available to the public, shows that there have been both war crimes and crimes committed against humanity, which were enshrined in the Rome Statue, Articles 7 and 8 respectively,” noted the specialist.
At the same time, A. Vardevanyan added that such a violation of crimes against human rights by Azerbaijan clarifies their decision not to sign the Rome Statue; nevertheless, the International Criminal Court can examine such cases against States which have not signed the Statute. Here the motion of the UN Security Council is required. For the public, the evidence clarifies that ownership rights of a number of people were violated purposely. I believe that since Azerbaijan destroyed civilian settlements, it is important to file a corresponding case with the European Court of Human Rights since among other violations, there is a blatant violation of personal rights.”
