According to the indictment, Karen Ghukasyan, broke the requirement of the RA Code about “The provision of road safety”, that is being drunk, drove exceeding the acceptable speed defined for those conditions, he slept while being in process, making an emergency situation on technical notion. As a result of this, the car deflected from traffic, collided a dam and tilted, and the transient Vardan Avagyan died. The judiciary informs about this.
In the Court of General Jurisdiction of Ajapnyak and Davtashen Administrative Districts of Yerevan, before beginning the trial, the accused person mediated to hold the judicial inquiry in accelerated order. The court satisfied the mediation.
The Court decided to recognize Karen Ghukasyan guilty under the provisions of Article 242, Part 2 of the RA Criminal Code and sentence for 2 years, depriving the right to drive for 1 year.
The defendant and his advocate appealed the decision to the Criminal Court of Appeal indicating that the Court did not notice the fact that Karen Ghukasyan is 22 years old, studies at University, got dangerous physical injuries for life, somewhat lost his memory, is in recovery process yet, his relative Manouk Petrosyan’s death was very painful for him and he completely compensated the loss.
Nevertheless the Court decided to reject the defendant’s and his advocate’s appeal.
