On 31 December 2012, 2.5-year-old child Lia Misakyan had fever and convulses. Her father took her to “Arabkir” Medical Center on an ambulance. The child died on 2 January 2013.
After two years, on 15 June 2015, the Court of General Jurisdiction of Arabkir and Kanaker-Zeytun District Court issued its verdict. The court recognized the two doctors, Lilit Vardanyan and Zarine Ayvazyan guilty in the child’s death.
Judge Levon Avetisyan recognized Lilit Vardanyan guilty under Article 130 Part 2 of the RA Criminal Code and sentenced her for the term of two years, without any additional sanction. Zarine Ayvazyan was sentenced under the same Article to the term of 2 years and six months. The defendants were released from the main punishment under the 2013 amnesty act.
After the verdict, the defendant Lilit Vardanyan began to cry and shout. She accused the deceased child’s father Georgi Misakyan. It should be noted that the victim’s party had not filed civil claim, otherwise amnesty could not have been granted to the accused, in accordance with the Criminal Procedure Code.
Notably, the defendants’ relatives were very aggressive; they entered into a dispute with the photo-journalist who was taking photos of the defendants.
In the interview with Iravaban.net, Georgi Misakyan, the victim’s successor considered the verdict just and said, “It is just not normal that the persons who had employed them were not involved in the case and there is not any verdict referring to them.”
Arthur Sakunts the victim’s representative said that Lia Misakyan’s death was the result of a result of inadequate medical care and in good faith. “We believe that many issues are related to unfair treatment not only of the doctors, but also because of the quality of care and inadequate organization of activities. We shall file our claim not only against the doctors, but also the institution where they work.”
