As we had informed Khachagrurt Khachatryan, judge of the Court of general Jurisdiction of Lori marz was arrested. The Council of Justice had applied to the RA President with a motion to apply arrest as measure of restraint.
Mr. Karen Tumanyan, the defender of the judge’s right informed that the Council of Justice had conducted two session, “One on involvement of Khachatur Khachatryan as a defendant and the second on applying to the RA President with request to apply remand.” The session took place on 26 December. On 27 December the request was submitted to the President. President Serzh Sargsyan agreed on involving as a defendant and rejected applying remand, seeing no grounds for that. On 27 December after the rejection of the motion, the Council of Justice held a regular session at 19:00. I was informed about that by an e-mail just 20 minutes prior to the session, but I answered that I would not participate as I was not familiarized with the materials and cannot carry out effective defense. However the Council of Justice held the session under these circumstances and again applied to the President with request to apply arrest as a measure of restraint. The RA President provided his consent in the morning on 28 December,” said the Advocate. “The problem here is that the Council could not submit for the second time a proposal on the same issue and on the same grounds on detention of the same judge. That is the legislative had forbidden to hold a second session on the same issue,; the advocate added.
Speaking of the future actions, the lawyer said that the defense intends to implement a series of actions, “We intend to carry out actions against the breach of the presumption of innocence. We are going to appeal the actions of the Council of Justice as well. Given the fact that there is no such possibility in the national court we shall challenge it the international court,” said the advocate.
