“It is very important that the ECtHR decision mentions the statement of 9 November, and that statement clearly mentions the provision of free movement of people, goods and vehicles through the Lachin corridor. It is no coincidence that the court quotes that statement. In other words, this means that we can now get up, go and pass through the Lachin Corridor,” Yeghishe Kirakosyan, Representative of the Republic of Armenia on International Legal Affairs, said in a conversation with journalists today, referring to the fulfillment of Armenia’s request by the ECtHR.

He said that according to the ECtHR decision, no extreme measures are even expect from Azerbaijan, the toolkit has limitations, but there are also other platforms that will oblige Azerbaijan to take steps, for example, there is the Committee of Ministers, which, being the main political body of the Council of Europe, also monitors the execution of court judgments. Yeghishe Kirakosyan noted that after such decisions, Armenia should do serious work in the diplomatic field.

Lets note that the European Court decided, on the basis of Rule 39 of the Rules of Court, to oblige Azerbaijan to take all necessary and sufficient measures to ensure the movement of seriously ill persons who need medical care in Armenia through the “Lachin Corridor”, as well as the safe movement of people left homeless on the road or in need of livelihood.  The Facebook page of the representative of the Republic of Armenia on International Legal Affairs reported.

On 21 December, the European Court examined the request of the Armenian government to apply interim measures against Azerbaijan, noting that at the moment the issue of Azerbaijan’s control over the “Lachin Corridor” is controversial, as well as taking into account the obligations assumed by Azerbaijan under point 6 of the trilateral statement of 9 November, 2020, in particular, “to guarantee the safety of movement of persons, vehicles and cargo moving through the Lachin Corridor in both directions”, and recalling the obligations assumed by the European Convention, the European Court decided, on the basis of Rule 39 of the Rules of Court, to oblige Azerbaijan to take all necessary and sufficient measures to ensure the movement of seriously ill persons who need medical care in Armenia through the “Lachin Corridor”, as well as the safe movement of people left homeless on the road or in need of livelihood.

At the same time, the European Court has decided to prioritize  complaint No. 4 submitted by Armenia, according to Rule 41 of the Rules of Court.

Let’s note that on 15, 16, 20 and 21 December of this year, Armenia submitted a request to apply an interim measure and additional information to the European Court, asking for an interim measure to be applied to Azerbaijan in order to eliminate the violations of the rights of the civil population’s as a result of the blocking of the road passing through the “Lachin Corridor”.
