The Building for the Anti-Corruption Committee to be built in Ajapnyak: Government Decision

At the 6 August regular sitting, the government made a decision on the location of the building for the Anti-Corruption Committee.

The justification of the decision states that the decision N 1332-N of the Government of the Republic of Armenia of 3 October, 2019, “On approving the Anti-Corruption Strategy of the Republic of Armenia and its Implementation Action Plan for 2019-2022,” envisages to form an anti-corruption law enforcement body, the Anti-Corruption Committee, with the functions of detecting corruption crimes, having investigation functions and having sufficient guarantees of independence..

An important component of the institutional system in the fight against corruption is the existence of a specialized body with the function of detecting corruption crimes, guaranteed by independence. The strategy is to provide the Anti-Corruption Committee with a separate area and, accordingly, to build a building that meets the required standards. At the same time, it is envisaged that the Anti-Corruption Committee should be formed in 2021.

In this context, it should be noted that according to the RA Government Decision N 348-A of 19 March, 2020, the 15-hectare land adjacent to the railway station “Spandaryan” in Ajapnyak administrative district, which is a community property of Yerevan, according to the appendix, was donated to the Republic of Armenia, after which it was attached in accordance with the requirement of Part 5 of Article 5 of the RA Law on Regulation of Administrative Legal Relations to the State Property Management Committee of the Ministry of Territorial Administration of the Republic of Armenia, as well as the State Registration and record of the Land Ownership of the Republic of Armenia. Then the land attached to the State Property Management Committee of the Ministry of Territorial Administration was taken back, it was attached to the Ministry of Justice.

At the same time, the RA Ministry of Justice, in cooperation with international partners, collected and submitted to the RA State Committee on Urban Development the needs for the construction of the Anti-Corruption Committee building. As a result, the RA State Committee on Urban Development, based on the orders of the Minister of Urban Development of the Republic of Armenia N 35-N of 3 April, 2009 and N 19-N of 15 February, 2008 and the decision of the Government of the Republic of Armenia N 879-N of 23 June, 2011, calculated design and construction costs.

Thus, it is proposed to establish an Anti-Corruption Committee in the area, for the construction needs of which, among other works, it is necessary to carry out design work.

At the same time, taking into account the fact that the realistic period of elaboration of design and estimate documents is at least 6 months, moreover, it includes the duration of the procurement process necessary for the acquisition of design works, at this stage it is proposed to allocate 25% of the calculated amount to the the RA State Committee on Urban Development, which will be provided to the design company as an advance payment.
