The Functions and Powers of Human Rights Defender Have Been Defined: The New Draft Constitution

As we have previously informed the Specialized Committee on Constitutional Reforms has published the preliminary draft of 1-15 chapters of the Constitution for public debates. The Specialized Committee informs that the draft has been published in the official website of Ministry of Justice of RA. Article 190 of Chapter 10 defines the functions and responsibilities of the Human Rights Defender.
Pursuant to it, the Human Rights Defender is an independent official who is responsible for ensuring non violation of human rights and fundamental freedoms by the state and local authorities, for improvement of legislation concerning human rights and freedoms.
The Human Rights Defender is authorized in other spheres concerning the protection of human rights and fundamental freedoms.
The Human Rights Defender shall deliver a report to the National Assembly on his/her activities and on the condition of the protection of human rights and freedoms. The report may contain suggestions concerning legislative changes or other kind of measures.
The Law on Human Rights Defender defines the powers, form and guarantees of his/her activities.
