On 2 July 2015, the court session of case of the accident that occurred on 108th km of Yerevan-Gyumri roadway took place in the Court of General Jurisdiction of Shirak Marz. Victims Hasmik Hovhannisyan brought a claim with the demand of compensation. The interrogation of witnesses continued.
Erik Balayan who is an employee in “Imeks-Group” was the first to be interrogated. He told that on 10 November 2014, they went to Gyumri from Artik to exchange the goods. Reaching Horom-Gyumri crossroad “Kamaz” vehicle had to turn to the right to Gyumri. But Erik was busy with the arrangement of the invoices and bills, and he does not remember whether “Kamaz” vehicle stopped at the “Stop” sign or not. He also told that he did not see the “Gazel” vehicle. Nevertheless he mentioned that in his opinion “Kamaz” vehicle was moving at the speed of 30-40 km/h speed, and “Gazel” vehicle at about 120-130 km/h.
After answering the prosecutor’s and the successors’ questions, Samvel Vardanyan asked the following question: “How can’t you remember me stop at the “STOP” sign, when you yourself made a remark on our friend’s Aram’s sleeping?” Erik answered that he remembered such a thing, but he could not tell exactly on which part of the road it occurred.
As long as there were contradictions in Erik Balayan’s testimonies made during preliminary investigation and trial, as he told that before the clash he had seen the “Gazel” vehicle riding at a speed of 70-80 km/h, and that in his opinion “Gazel” was guilty in the accident, the driver of “Kamaz” vehicle said that he was interrogated from 1:00 to 5.00 in the morning. “Naturally, I was shocked to see burnt people, and also I was sleepy. The inspector told that if it had stopped I would have certainly noticed it, and I did not object”, – told the witness. Then the employees of the gas station near the crossroad were interrogated. A decision to ensure the attendance of witness who failed to attend the court hearing was made.
The court session was delayed up to 10 July 2015.
