“One of the most problematic problems in current legislative sphere refers to the civil procedure and having a new code is a long standing necessity,” said Mr. Hunan Ter-Vardanyan, advocate, PHD in Law in the interview with Iravaban.net, and added that the new code is one of the legal instruments which underwent the most changes.
According to him, the current priority issues of the civil procedure concern the burden of proof, which refer to its distribution and the absence of the terms of the trial.
Specifically, no time limits are set referring to after how much time the next session shall be set, or how much time after submission of the application shall the first session be set.
“I have had a case, for which the first court session was set after four months after submission of the application. Due to the lack of legislative regulations the parties have opportunity to prolong trial,” said the advocate.
