Citizen Ashot A. filed a report with the Special Investigation Service of the Republic of Armenia declaring that a ban under the civil case was imposed on the land, car maintenance service and tire service centers owned by him on basis of the ownership right. The employee of the Compulsory Enforcement Service of Judicial Acts of the Ministry of Justice of the Republic of Armenia made a decision about selling the property under ban via an electronic auction and in the course of the executive proceeding the bailiff failed to fulfill his duties proceeding from the actions of plaintiff to the civil case Vahagn K. In other words, he failed to notify of the decision about the organization of an electronic auction in the manner prescribed by law, as a result of which he was deprived of the opportunity to participate in the auction and as a result of selling the property at a price obviously lower than the actual price through an electronic auction he sustained material damage (the property costing USD 140.000 was sold at 5 million Armenian drams). A criminal case has been initiated based on the report of the citizen Ashot A. as per the materials prepared in the Special Investigation Service of the Republic of Armenia with regard to the abuse of employment-related powers of the bailiff in accordance with Part 1 of Article 308 of the Criminal Code of the Republic of Armenia. A preliminary investigation is in process.
