In 2007 and 2008, the former Head of the Masis Community of Ararat Marz, S.H., carrying out criminal activity, stole the 599.7 square meter administrative building located at 11 Azatamartiki street, Masis city, and the 385 square meter land where it was located, as well as the warehouse of the administrative building of 244.5 square meter located at 11/1 Azatamartiki street and the 299 square meter land on which it was located.
On 18 April, 2023, a public criminal prosecution was initiated against the former Head of the Masis Vommunity, S.H., under Article 179, Part 3, Clause 1 of the Criminal Code adopted on 18 April, 2003 (squandering or embezzlement in particularly large amount) and items 1 and 3 of part 3 of Article 190 (legalization of particularly large amounts of income obtained by criminal means using an official position, money laundering).
In particular, through carrying out criminal proceedings, factual information was obtained that S.H., who has been the head of Masis City Community of Ararat Marz since 1999, on 27, December 2007, presented to the Council of Elders for discussion the issue of allocating the administrative building the 599.7 sq.m. and the warehouse of the administrative building with an area of 244.5 square meters located at 11/1 Azatamartiki street to the member of the Council of Elders, Director of “SIS” CJSC AB. On the same day, the Council of Elders donated the mentioned properties to A.B.
Further, on 11 February, 2008, in order to register the administrative buildings located at Azatamartiki 11, in the name of the director of “SIS” CJSC A.B., the former Head of the Masis Community S.H. presented to the discussion of the Council of Elders, the issue of alienating the plots of land for public development of settlements with the area of 385 square meters and 244.5 square meters located at the same address to A.B. through direct sale. On the same day, the Council of Elders passed a positive decision. According to the preliminary investigation, it was found that the amount specified in the contract for the land area of 385 square meters was given to A.B. by the head of the community.
As a result, properties with a value of 48 million 160 thousand drams were registered in the name of A.B., a member of the Council of Elders.
Then, S.H. reached an agreement with A.B. regarding the registration of the administrative building with an area of 599.7 square meters and the land area of 385 square meters encumbered by it in the name of his advisor R.K., promising that after the end of his tenure and when the properties came under his control, he would sell them and transferred 40,000 USD to A.B., and in exchange for the help provided to leave to A.B. the warehouse of the administrative building with an area of 244.5 square meters and the land area of 299 square meters encumbered with it, located at 11/1 Azatamartiki Street, Masis city,
On 28 February, 2008, the member of the Council of Elders A.B., in order to assist his accomplice, the Head of Masis Community, at the request of S.H., signed a purchase and sale agreement worth 39 million 200 thousand drams, with the advisor R.Gh, regarding the sale of the building and the land to R.Gh. for only 1 million drams.
On 7 November, 2017, S.H., when he was no longer the head of the Masis City Community, instructed R.Gh. to alienate the said building with its plot and equal shares to his son A.H. and to his colleague A.R.’s brother A.L.’s daughter N.S.
On 8 May, 2023, the supervising prosecutor submitted the indictment to the court along with the materials of the proceedings.
