The preliminary investigation of the criminal proceedings initiated on the fact regarding N.H.’s case of showing disrespect to the court, has been completed in the Armavir Marz Investigation Department of the RA Investigative Committee.

The Investigative Committee reported.

Based on the factual data obtained as a result of the investigative and administrative operations, it was justified that after the ruling the decision in the civil case, by the judge of the First Instance Court of General Jurisdiction of Armavir marz of the RA, by Ed. Hovhannisyan, on 29 March, 2023 at 4:50 p.m., a post regarding the exercise of the judge’s official powers was made in the comments section of the “Nairi Hokhikyan” Facebook page, by the user Nariri Hokhikyan, disrespecting the said judge, and an insulting expression was used against the judge. There are also photos attached to the post.

Based on the obtained sufficient facts, N.H. was charged under Article 489, Part 2 of the Criminal Code of the Republic of Armenia. The ban on absence was chosen as a measure of restraint against him.

The investigation is over. The materials of the criminal proceedings, with the indictment, were sent to the supervising prosecutor for approval and sent to the court.

Note: A person that is suspected or accused of an alleged crime is considered innocent until his/her guilt is proved by a court judgment that has come into legal effect pursuant to the procedure determined by RA Criminal Procedure Code.
