On 24 March, the Anti-Corruption Civil Court continued the examination of the claim filed by the Prosecutor General’s Office regarding confiscation of property and funds of allegedly illicit origin of Narek Lyova Sargsyan, the nephew of the 3rd President of the Republic of Armenia, Serzh Sargsyan, and his wife, Anna Nikoyan.

The prosecution requests the defendants to confiscate the following properties and funds:

• To confiscate from Narek Sargsyan, the residential house in Arzakan village of Kotayk Marz, and in case of impossibility, to confiscate the average market value of the property – 55 million 125 thousand AMD.
• The 25-hectare plot of land located in the Myasnikyan Community of Armavir Marz, if it is impossible; confiscate the average market value of 24 million AMD.
• The plot of land located in Zartonk Community of Armavir marz, in case of impossibility, confiscate the average market value of the property – 6 million 600 thousand AMD. 
• The plot of land at 10/2 Fuchiki street of Ajapnyak Community, in case of impossibility, confiscate the average market value: 70 million 900 thousand AMD.
• The plot of land at 10/1 Fuchiki street, Ajapnyak Community of Yerevan, in case of impossibility, confiscate the average market value of the property: 127 million 800 thousand AMD.
• Half of the basement floor area of ​​20 Shahumyan Street, Dilijan city, in case of impossibility, confiscate the average market value of the property – 10 million 125 thousand AMD.
• The plot of land located in the Merdzavan Community of Armavir Marz, and in case of impossibility, confiscate the average market value of 3 million 650 thousand AMD.
• Nissan Altima car, in case of impossibility, confiscate the average market value of the property: 2 million 400 thousand AMD.
• Narek Sargsyan’s participation in “Netrino” CJSC in full, and in case of impossibility, confiscate the average market value of 33 million 58 thousand 938 AMD.
• Narek Sargsyan’s 20 shares in “Megaton” CJSC, in case of impossibility, the market value: 10 million 669 thousand 536 AMD.
• Confiscate the right of claim arising from the loan provided to the “Mini Maya” LLC in the amount of 3 million 835 thousand 297 AMD.
• Confiscate from Narek Sargsyan and Anna Nikoyan in favor of the Republic of Armenia, the area located on Buzand Street in Yerevan as property of illicit origin, and in case of impossibility, to confiscate the average market value of the property: 302 million 150 thousand AMD.
• From 1 January, 2021 until the actual execution of the judgment, the sums received from the lease signed with the “Vanitar” LLC for the premises No. 27, Buzandi Street, 3, Yerevan, as income from property of illicit origin: 2 million 200 thousand AMD per month, according to the contract.
• The deposit of 1 million 489 thousand 185 USD in the account of “Armbusinessbank” CJSC.
• From 28 April ,2021 until the day of the actual execution of the judgment, the interest calculated on the deposit in the amount of 1 million 489 thousand 185 USD in the account of “Armbusinessbank” CJSC, as income from property of illicit origin.
• The deposit of 987 thousand 661 USD in another account of “Armbusinessbank” CJSC. 
• From 28 April, 2021 until the day of the actual execution of the judgment, the interest calculated on the deposit in the amount of 987 thousand 661 USD in the account of “Armbusinessbank” CJSC, as income from property of illicit origin. 
• 33 million 742 thousand 695 AMD from the interest received from that deposit to another account of “Armbusinessbank” CJSC. 
• 2021 from April 28 until the day of the actual execution of the judgment, the interest calculated on the 33 million 742 thousand 695 AMD in the account of “Armbusinessbank” CJSC, as income from property of illicit origin. 
• 319 thousand 55 USD from the interest received from the deposit in the account of “Armbusinessbank” CJSC.
• From 28 April, 2021 until the day of the actual execution of the judgment, the interest calculated on the 319 thousand 55 USD available in the specified account of “Armbusinessbank” CJSC, as income received from property of illicit origin. 
• In addition, to confiscated from Narek Sargsyan in favor of the RA, 488 million 890 thousand 258 AMD; AMD equivalent to 654 thousand 86 USD; and AMD equivalent to 142 thousand 381 Euro as the balance of illicit funds. 
• 42 million 859 thousand 690 AMD, which is not justified by the legal income of the person, is of illicit origin and cannot be confiscated because it has been transferred to a bona fide acquirer or cannot be identified, separated and confiscated during the entire study period, 2004-2020.

According to Iravaban.net , during today’s court session, the representative of the defendants, Vahagn Grigoryan, mediated to involve “Haybusinessbank” CJSC as a third party in the case,.

The Court, presided over by Judge Ashkhen Gharslyan, offered to proceed to the next trial stages, if the parties do not object as, “According to the Civil Procedure Code, the decision on the mediation shall be made in the form of a separate judicial act. During this session, the Court cannot make a protocol decision. Is there any action we can take during this preliminary hearing?’

Vahagn Grigoryan stated that he does not want to raise questions about the basis and subject of the claim at this sessions, until the court act on the involvement of third parties is ready. “The number of questions is not 1, 10 or 20. It is much more. I think they will take a long time.”

The court left for the deliberation room to rule on the motion.
