The National Assembly adopted in the second reading the draft submitted by the government, which allows the employer not to allow an employee who does not have a coronavirus vaccination or PCR test certificate to be at work, to perform his/her job duties, up to terminating the employment contract.
The package of drafts received 60 votes in favor and 26 against in the NA sitting. In case of non-fulfillment of job responsibilities of more than 10 working days (shifts) in a row or more than 20 working days (shifts) during the last 3 months, the employer is reserved the right to terminate the employee’s employment contract. In case of termination of the employment contract, the employer must notify the employee in writing no later than 3 days in advance.
Exceptions have also been provided. These regulations do not apply to the President of the Republic, Member of the National Assembly, Prime Minister, community leader, member of the community council, ombudsman, judge of the Constitutional Court, member of an independent state body, member of the autonomous body, member of the State Council of Statistics, judge of the cassation, appellate courts or the court of first instance, and on the positions of the Prosecutor General.
These positions are either elective positions or are elected by the force of the Constitution, they have no superiority.
