Circumstances excluding the Proceedings on Cases of Administrative Offence

A decision to terminate proceedings in a case concerning an administrative offense shall be issued in the event of:

1) absence of administrative offense case or absence of corpus delicti;
2) if the person has not reached sixteen years of age at the moment of violation;
3) imputability of the person staying inactive or committing illegal action  
4) the action of the person in the extreme necessity or necessary defense situation.
5) publication of amnesty act, if it eliminates the application of administrative penalty.
6) elimination of the act defining administrative responsibility.
7) Expiration of terms provided by Article 37 during the examination of administrative offense case.
8) the presence of competent authority’s (official’s) decision about the same fact or amicable court unreversed decision toward the person subjected to administrative responsibility if the materials were sent to the court by the authority (an official) who had the right to appoint the administrative sanction for that case, or the presence of amicable court unreversed decision about dismissing the case, also the presence of the criminal case for the same fact.
9) the death of the person towards whom the proceeding was started.
