Adviser to the RA Prosecutor General Gor Abrahamyan wrote on his Facebook page:

“Recently, the RA Court of Appeals upheld the appeal of the Prosecutor’s Office, overturned the decision of the Shirak Region Court of First Instance, and chose detention as a measure of restraint against Spartak Ghukasyan, accused in the criminal case.

It should be reminded that in the criminal case under investigation in connection with the case of threatening to use violence against a police officer, on 18 August, 2021, Ghukasyan was charged under Article 316, Part 1 of the RA Criminal Code by the body conducting the proceedings, and a motion was submitted to the court to choose detention as a measure of restraint.

As a result of the consideration of the motion, on 20 August, the Court of First Instance of Shirak Region rejected the motion, considering that there is a risk of obstruction of the case by the accused, but it is low; and the proper conduct of the accused may also be guaranteed in the case of non-custodial restraint, leaving it to the discretion of the prosecuting authority.

The Shirak Region Prosecutor’s Office filed an appeal against this decision, which was upheld today.”
