The Ministry of Justice has submitted for public discussion the draft laws related to the Law on Making Amendments to the Constitutional Law the Judicial Code of the Republic of Armenia.
According to the Draft Laws “On Making Amendments to the Constitutional Law of the RA Judicial Code”, “On Making Amendments to the RA Administrative Procedure Code” and ” On Making Amendments to the RA Civil Procedure Code”:
- It is envisaged to create two independent chambers with separate specializations on the basis of the Civil and Administrative Chamber of the Court of Cassation;
- Issues related to the formation of the civil and administrative chambers of the Court of Cassation and the provision of normal activities are regulated.
The justification of the draft states that the RA Constitution established the administrative court as a specialized court, thus creating guarantees for the efficiency and completeness of the exercise of the right to judicial protection in the given sphere, taking into account the peculiarities of this type of justice. However, in the field of administrative justice, there is no provision for the specialized chamber to review judicial decisions of the Court of Appeal, as this power is vested in the Civil and Administrative Chamber of the Court of Cassation.
