“According to the law, a legal scientist has no other way to appear in the Supreme Judicial Council, except to be nominated by factions.”
Former RA Military Prosecutor Gagik Jhangiryan, whose candidacy is currently being discussed for the vacant position of a member of the Supreme Judicial Council, said this today, on 13 January, after the meeting with the NA “My Step” faction.
“Since the nomination by seemingly smaller factions is not a guarantee that the votes will be satisfied, because 3/5 is required for the election, naturally I have agreed with the nomination by the seemingly majority faction. But I do not run for executive power, I do not hold a political position; I do not become a member of a political team; I am going to a professional job.
Jhangiryan mentioned that he would not mind being nominated by the other factions of the National Assembly, the Prosperous Armenia Party and Bright Armenia Party.
As for the age limit set by law for reaching the age of 65, he said that they could open Article 86 of the Judicial Code, which deals with the grounds for termination of powers, according to which age limits are provided for judges and age limits for lawyers-scholars. There is no maximum limit.
“According to the same code, the former chairman of the Constitutional Court Gagik Harutyunyan was elected chairman of the BDK after turning 70 years old. Unfortunately, they have not studied the Judicial Code well, especially Article 186, which refers to the grounds for termination or termination of powers. Will you see in that article that there is an age limit for judges in that article, other than Article 112 restrictions? There is no maximum age limit for lawyers-scientists. Therefore, if one is elected at the age of 62, according to the logic of that statement, Article 186 would have provided the basis for that automatic termination at 65. They interpret the law not by reading any article; the law should be interpreted in all its articles. I have specifically studied this issue. 65 years is not envisaged for a lawyer-scientist either by the Constitution or the Judicial Code.”
As for the working atmosphere, he mentioned Most of the SJC Staff are my students, my colleagues; I do not see an ill atmosphere there.”
