The Ministry of Education, Science, Culture and Sports has submitted for public discussion the draft law on making changes in the order of formation of the board of the collegial governing body of general education institutions. In order to implement the school management process more effectively and objectively, to ensure further independent, unhindered and effective activities of the councils, the draft proposes:

  • Introduce the idea of ​​enlarging school councils. Accordingly, a separate council will be formed in the case of institutions operating in settlements with a population of at least 3,000, and in the case of institutions operating in settlements or communities with a population of up to 3,000, a joint council will be formed, including a maximum of three institutions. According to the draft, the separate council consists of 11 members, and the joint council has a maximum of 19 members.
  • Introduce the principle of rotation of council members, stipulating that the same member cannot be included in the council more than twice. This will make the process more participatory, and more pedagogues and parents will have the opportunity to be involved in the work of the council..
  • Expand the circle of pedagogues entitled to be involved in the council, removing the requirement to have a maximum of three years of experience in the institution.

The RA legislation also stipulates that in the defined period after the change of the council formation procedure, the processes of complete re-formation of the councils of the existing institutions must be carried out.

It should be noted that currently the school management councils have a wide range of powers. Research in the field, data from regular monitoring of school activities, as well as individual cases that are widely publicized show that these councils do not always act as a collegial governing body of the school, mainly formed for one main purpose – the election of the principal, which in turn overshadows the other powers of the council. In recent years, some of the school governing councils have been involved in politics, particularly in the electoral process, which has had a significant negative impact on the effective functioning of this body. In the case of small communities, it is a separate issue to exclude conflicts of interest in the case of kinship ties.
