Accordingly, first of all, I would like to note that the rejection of the motion is not due to reasonable suspicion, i.e. the court considered that there is a reasonable suspicion, but refers to the grounds for choosing detention as a measure of restraint, in particular, to exert illegal influence on persons participating in criminal proceedings, to conceal or falsify the materials relevant to the case, to summon the body conducting the criminal proceedings without any good reason or to obstruct the investigation of the case in any other way.

According to the prosecutor’s office, the court ignored and did not properly assess the grounds for mediation regarding the grounds for choosing pre-trial detention, the risks that were conditioned by the fact of the party structures under his actual control during the preliminary investigation in case of freedom. In the context of the need to obtain documents, the possible multiplicity of persons involved in the commission of an alleged crime, the use of his connections and financial resources in the context of the broad geography of the alleged crimes, the authority and influence over the persons allegedly involved in the crime; to prevent the real risks posed to the court by obstructing the investigation by hiding material relevant to the case.

Therefore, since an unfounded and illegal judicial act has been made by the court, the RA Prosecutor’s Office will definitely appeal it to the RA Criminal Court of Appeal,” he said.
