According to the RA Constitution, a RA NA deputy can be arrested with the consent of the National Assembly (such a consent does not exist) or at the moment of committing a crime (there is no such factual basis), therefore the legal grounds for Gagik Tsarukyan’s arrest are missing.
- On the duration of the interrogation
The duration of the interrogation may not exceed 8 hours in one day, provided that the interrogated person is provided with a one-hour break (Parts 1 and 2 of Article 205-1 of the RA Criminal Procedure Code).
- About Gagik Tsarukyan not communicating
The investigator shall take measures so that the witnesses called in the same case do not communicate with each other until the end of the interrogation (Part 3 of Article 206 of the RA Criminal Procedure Code).
