Artur Vanetsyan, the former head of the National Security Service’s defense group, issued a statement informing that the group would file a civil lawsuit against the “Haykakan Zhamanak”(Armenian Times) daily.
“As it is know we had demanded from the company“ Dareskibiz ”LLC (Haykakan Zhamanak, armtimes.com) to refute the false, libelous information about Arthur Vanetsyan in an article titled“ Do I Have Honor or I have No Honor…” published on this site on 12 January. The application and the content of the refutation were published by us, and the public was able to find out, individually, what particular expressions were defamatory and which needed to be completely denied.
Today, however, we have received a letter from the company probably addressed to us, which states that the “denial application and the text of the denial attached” are not subject to discussion by the company.
By the same letter, however, making both the application and the text of the denial subject to discussion, the author notes:
- A. Vanetsyan’s representatives, under the power of attorney given by him, have “the right to submit a retraction claim” but have no “authority to present a retraction text with such content.”
- The text of the denial and the application do not state that “the article published specifically stated that the statements were defamatory or infringing on Arthur Vanetsyan’s rights.”
Whereas, pursuant to the power of attorney given to us, we are authorized both to file a “claim for refutation of a published material, including to submit a refutation text”, and “to make statements, to submit and receive documents, applications, complaints, reports, other materials, to sign all necessary documents.”
We believe this note is fully equivalent to the content of the article published on 12.01.2020, its additional interpretation is a waste of time, and time should be used effectively to prepare a civil claim and to file it in court as soon as possible.
