Aram Vardevanyan, representative of the Second President of the Republic of Armenia Robert Kocharyan in the Constitutional Court, reported to Justice Minister Rustam Badasyan on a disciplinary violation by the Judge of the Court of Appeal Armen Danielyan requesting to take measures to bring him to disciplinary liability and to institute proceedings.
Notably, on 25 June 2019, Judge Armen Danielyan overturned the first-instance court’s ruling to abolish the measure of restraint personal guarantee and to apply detention. By another decision of the same day, Judge A. Danielyan had remanded the verdict of the court of first instance on “Applying to the Constitutional Court and suspending the proceedings”.
According to Defender A. Vardevanyan, Judge Danielyan has made these decisions with gross material and procedural violations, in particular the right to a fair trial under the ECHR Convention. The judge presiding over the hearing did not periodically allow the defense to present its position, deprived them of their right to speak, which is unprecedented in judicial practice, especially in the context of detention.
