Vachagan Ghazaryan, the first deputy head of the NSS  State Protection Service of Armenia, who was in this post till 17 May 2018, was arrested on June 25, by the decision of the Investigator of the Special Investigation Service of the RA,

He is suspected of committing crimes provide by Article 310.1 and Article 314.3.2 of the RA Criminal Code of the RA, as well as falsifying data in the declarations envisaged by the RA Law on Public Service and concealing the data subject to declaration.

It should be noted that Article 310.1 of the Criminal Code establishes the illegal enrichment, according to which,

1. Illegal enrichment is the increase in assets and (or) reduction of liabilities substantially exceeding its legitimate returns and are not reasonably grounded in the reporting period by a person who has a duty to file a declaration defined by the Law of the Republic of Armenia “On Public Service”, and if the grounds for illicit enrichment other offenses are missing, are   punished with imprisonment for a term of three to six years, deprivation of  the right to hold certain posts or practice certain activities for up to 3 years with confiscation of property.
2. In this Article, the amount (value) exceeding five thousand times the minimum wage established at the time of the crime shall be deemed essential.

Article 314.3 defines false representation in the declarations or concealment of the data subject to declaration, according to which

1. Falsifying data in the declarations provided by the Law of the Republic of Armenia “On Public Service” or concealing the data subject to declaration by a person acting as an official, as well as his/her family, is punished with a fine in the amount of 200-300 thousand AMD of the minimum salary or with imprisonment for a maximum of 2 years with deprivation of the right to hold certain positions or engage in certain activities for a maximum period of three years or without it.
2. The same action that resulted in a particularly large amount of property or income is punished with imprisonment for a term of 2 to 4 years with deprivation of the right to hold certain positions or to engage in certain activities for a maximum period of three years or without it.

Note: A person that is suspected or accused of an alleged crime is considered innocent until his/her guilt is proved by a court judgment that has come into legal effect pursuant to the procedure determined by RA Criminal Procedure Code.
