Member of the National Assembly Manvel Grigoryan was charged on June 18, pursuant to the article 235, part 2 and article 179, part 3, point 1 of the RA Criminal Code.

Below we present what will be his punishment if the alleged Charges against him are proved.

Article 235 of the Criminal Code provides  for “Illegal procurement, transportation or carrying of weapons, ammunition, explosives or explosive devices,” according to which:

1. Purchase, sale, storage, transportation or carrying of ammunition, ammunition, ammunition, ammunition, explosives, or explosive devices, other than firearms and bullets, or other illegal weapons, is punished with arrest for the term of up to 3 months, or with imprisonment for the term of up to 3 years.
2. The actions envisaged in part 1 of this Article which were committed by a group with prior agreement, are punished with imprisonment for the term of 2 to 6 years.
3. The acts envisaged in part 1 of this Article, committed by an organized group, are punished with imprisonment for a term of 3-8 years.
4. The actions envisaged in part 1 of this Article which were committed by an organized group, are punished with imprisonment for the term of 3 to 8 years.

Article 179 of the same Code  provides for “Squandering or embezzlement”.  According to Article 179:

1. Injury or deprivation, theft of property of someone else entrusted with the criminal, is punished with a fine of 300-500 thousand AMD or imprisonment for up to 2 months, or with imprisonment for the term of up to 2 years.
2. Squandering or embezzlement is theft of somebody’s property entrusted to the person in significant amount, punished with a fine in the amount of 300 to 500 minimal salaries, or correctional labor for 6 months to 1 year, or with arrest for the term of up to 2 months, or with imprisonment for the term of up to 2 years.
3. Same action:

3) in large amount – shall be punished with a fine of 500 thousand to 1 million drams or with imprisonment for 2-5 years, with deprivation of the right to hold certain positions or engage in certain activities for a maximum period of three years or without it.

• with abuse of official position,
• committed by a group with prior agreement;
• in large amount, are punished with a fine in the amount of 500 to one million drams, or imprisonment for 2-5 years, with or without deprivation of the right to hold certain posts or practice certain activities for up to 3 years.

3. Action envisaged in part 1 or 2 of this Article, committed:

• in a particularly large amount,
• by an organized group, is punished with imprisonment for the term of 5 to 8 years, with or without property confiscation.

Note: A person that is suspected or accused of an alleged crime is considered innocent until his/her guilt is proved by a court judgment that has come into legal effect pursuant to the procedure determined by RA Criminal Procedure Code.
