This morning MP Edmon Marukyan applied to Vazgen Rshtuni, the Chairman of the RA Criminal Court of Appeal. The message of the delegate reads:
“This morning I sent an “amicus curiae” on Gaspari’s case to Vazgen Rshtuni the Chairman of the RA Criminal Court of Appeal. By this document, I substantiated the illegal character of the decision of the Court of General Jurisdiction of Shengavit Administrative District to arrest Vardges Gaspari. I especially emphasized that the necessity of the arrest was objectively missing; moreover the grounds of the decision of the arrest are not derived of the Domestic Criminal Procedure Code and of Article 5 of the European Convention on Human Rights as well. I substantiated that decision of the arrest does not have the objective to secure the presence of the defendant at the procedural actions as it is stated in the decision. In this case it was applied as punishment.
So, I have applied to the Court of appeal with request to annul the decision of the arrest and immediately release Vardges Gaspari.”
