Today the Courts arrest more People than the Prosecutors did in the Past; Aleksander Sirunyan

“The Investigator comes to the court with his flash, with the text of his solicitation, so that the Judge shall not spend extra time. By the way the text of the investigator’s solicitation and the text of the verdict very often contain the same mistakes,” Advocate Aleksander Sirunyan said in the interview with Iravaban.net, referring to the issues of the arrest.

Recently the advocates very often speech about the applied arrest as a measure of restraint, which is already spread like a disease and is not applied as an extreme measure of restraint as it was originally intended.

“When we were amending the Constitution in 1995, those prominent people, Khachatryan, Nazaryan, being the Prosecutors General of those days were active supporters of the idea that arrest should be applied through the courts and the prosecutors shall not continue with the issue. We were against it because of our departmental interest as I was working in the prosecution in those days.” according to Mr. Sirunyan, the former prosecutors general were for the idea that the judges should listen to the advocates and the prosecutors in equal conditions and then decide about the arrest of a person.

“But now it occurs that in those days the prosecutors were arresting less people than the court do today. When in former days the investigator presented a solicitation on arrest or to prolong the term of arrest, and then literally speaking he had to do sweat blood to justify his motion,” Mr. Sirunyan said.
