Illicit Enrichment Will Be Criminalized in Armenia within the Coming Three Months

The new program of the RA Government includes a number of provisions on fight against corruption. The provisions are, as follows: 

1) Put maximum efforts into the elimination of the biggest obstacles for the work of the state system that hinder the development of the country, that is, protectionism, appropriation, bribery and other manifestations of corruption;

2) Criminalize “illicit enrichment” within three months and introduce good mechanisms to ensure its implementation within six months;

3) Within six months:

a. Develop an institutional anti-corruption system, partly through reconsidering the principles of the formation of the council of fight against corruption;

b. Improve the public accountability of the preventive and law enforcement anti-corruption agencies;

c. Take measures aimed at the legislative enlargement of the scope of persons submitting income and asset declarations and the specification of the scope of related persons;

d. Take measures towards introducing the declaration of conflicts of interest as a legal institution; 

e․ Take measures towards introducing a good system of whistle-blower protection as a legal institution;

f․ Define legal regulations limiting transactions in cash; 

4) Within a year elaborate a legislation providing for stricter responsibility for committing offenses against the state service, taking into account the higher level of danger. 

Note: The proposal on a number of anti-corruption mechanisms, including the criminalization of illicit enrichment, was submitted to the Government by the Armenian Lawyers’ Association and the CSO Anti-Corruption Coalition of Armenia.
