Judge of the Court of General Jurisdiction of Kentron and Nork-Marash Administrative Districts Mnatsakan Martirosyan believes that the introduction of the probation service is really important for the Justice system.
According to him this service may sustain if the employees of the judicial system will pay attention and apply it. “In the new Criminal Procedure Code, which soon will come into force, while discussing the issues of applying detention as measure of restraint, the issue of gravity of the crime is primary when discussing the severe and especially severe crimes. I think that it is important to introduce the following into practice: when a medium crime has taken place, however if the issue of detention arises there should be the option of probation service. Which means: in case of the denial of detention that opinion shall not be obligatory, and in case of meeting the requirement of detention it shall be primary,”- said the judge.
He mentioned that he had been to Georgia and got acquainted with the probation service of that country: “There the service was not applied in the pre-trial proceedings, it was foreseen during the process of serving the term: it seemed like there were some complications.”
