Principle of Equality before the Law of the Participants of the Court Procedure

 

The persons who committed a crime are equal before the law and are subject to criminal liability regardless of sex, race, color, language, religion, political or other beliefs, national or social origin, ethnic minority identity, birth, property, or other statuses.

 

In the hearing of his case, everyone has the right to invoke, as legal argument, the reasoning of a final judicial act (including the construal of the law) of a Republic of Armenia court in another case with identical/similar factual circumstances.

 

The reasoning of a judicial act of the Cassation Court or the European Court of Human Rights in a case with certain factual circumstances (including the construal of the law) is binding on a court in the examination of a case with identical/similar factual circumstances, unless the latter court, by indicating solid arguments, justifies that such reasoning is not applicable to the factual circumstances at hand.
