The motion to detain the second president of Armenia Robert Kocharyan is being examined at the Shengavit residence of the Court of General Jurisdiction of Yerevan on July 26.
The session was postponed till 1:30 because Robert Kocharyan was not informed about the session. His attorney, Aram Orbelyan, told the reporters, who joined the case when the retired president was charged.
“It’s not clear, what’s the rush, to call a session at night, and now we will try to notify Mr. Kocharyan,” he said. The attorney also mentioned that the investigators involved in the case should notify the retired president of the trial on the motion for his detention.
Aram Orbelyan mentioned that he does not see reason to attend the session, although it is late and he personally does not call the people after 9 p.m.
He also noted that investigators, prosecutors, judges were tired and had worked since early in the morning and participate in investigative actions. “An example is that in such cases such sittings occur in different cases, it is definitely true, but even when a person’s freedom is restricted, and he is arrested, the Criminal Procedure Code defines 72 hours. At 72 hours 01 minutes, even if the session is underway, the person should be released,” he said.
Notably, On July 26, 2018, the former RA President Robert Kocharyan was charged with a criminal offense on the basis of sufficient evidence obtained during the preliminary investigation on the criminal case in the RA Special Investigative Service on the events that took place in Yerevan from 1 March 2008 to 2 March 2008. The former President has been charged pursuant to Article 300.1 Part 1 of the RA Criminal Code for the fact that he has overthrown the Constitutional Order of the Republic of Armenia with prior agreement with other persons.
