The Institute of Private Prosecution has been operating for a long time, it can be said that it is even older than the Institute of Public prosecution. The victims had to file a complaint so that the illegal act committed against them could be processed. Later, the state took over that responsibility.

The institute was planned both in the Criminal Procedure Code adopted in 1998 and by the Current Code.

Formerly there were types of crimes in the framework of private charges, on which criminal cases could be initiated only on the basis of the victim’s complaint.
