Degree of limitation of a person’s functionality instead of a disability group: A number of changes have been made
A transition from a system of medical and social expertise to a system of assessment of a person’s functionality is taking place.
On 5 May, the National Assembly of the Republic of Armenia adopted the package of draft laws “On the Rights of Persons with Disabilities”, “On the Assessment of the Functionality of the Person” and other related laws, which defined a number of regulations.
One of the significant changes is that in addition to doctors, health care professionals, such as ergotherapists, psychologists, social workers, and other professionals, will be involved in the evaluation, depending on the individual’s problem.
There will be a register of specialists and a few days before the assessment a random selection committee will be formed through a special electronic system, which will allow to exclude corruption cases.
The Ministry of Labor and Social Affairs will cooperate with the Ministry of Health and the Ministry of Education, Science, Culture and Sports to carry out the process of assessing a person’s functionality more accurately. No process extension is planned.
The amended law prohibits discrimination against a person with a disability; in the event of such discrepancies, NGOs have the right to file a lawsuit.
The amended laws also prohibit discrimination against persons with disabilities, and in the event of such manifestations, NGOs have the right to file a claim.
