Which Country’s Court will try the Gyumri Murder Case if Valeri Permyakov appears on the Dock?

The case of the Russian soldier Valeri Permyakov who is suspected in the murder of 6 family members in Gyumri, has been passed to the Russian Law Enforcement Bodies. The communication circulated by the Prosecutor General’s Office is an evidence of this.

Advocate Liparit Simonyan commented on the decision, “On the assumption of the fact that currently Valerie Permyakov is under the Russian jurisdiction, so the legal relations are regulated under the Minsk Convention. That is there is a question whether the issue of extradition exists or not. The RF Constitution does not allow extradition of their citizens. This is the answer,” the advocate said and concluded that in case if Permyakovn was arrested by the Armenian law enforcement bodies then we should have had a different picture.

The reply of the advocate to the question what would happen if Permyakov appears on the dock was, “It is the same situation. He will be sentenced under the RF laws. Russians have a military tribunal, which will examine the case.” The military tribunal is a court of general jurisdiction, which operates under the Russian armed forces and is a part of the judicial system of Russia.

The advocate also said that he had a similar case, but in the opposite situation, “A person was charged in a foreign country, but he was a citizen of the Republic of Armenia, and our country did not surrender him.”
