Large-Scale Amendments in the Civil Code. How will they be Implemented?

16 concepts directed at the RA Civil Code amendments. The Ministry of Justice has initiated the works towards amending this legal document. Around 20 concepts have been included in the section for public discussions in its official website.

The RA Civil Code was adopted on 5 May, 1998 and entered into force on 1 January 1999.

According to the President of the Chamber of Advocates the Civil Code is a successful document: “Replacing the former Soviet forms of property, it brought pretty good regulations. I think  this Code contributed to the economic development in our country. It also conditioned the fact that economic companies, their interrelationships, the issues of the participants` responsibilities were clarified”, said Mr. Zohrabyan, adding: “Certainly, every legal act has its drawbacks. Let us not forget that life goes on and develops, and the norms of behaviour should correspond to the tendencies of the development of life”

The subject of the International law generally includes the issues of applicable law, jurisdiction and the implementation and recognition of the foreign judicial and arbitration decisions, so international private law does not in any form regulate the content matter of the rights and responsibilities of the parties to the studied relationships, but only has a directing nature. This is the characterization of the institute of the “Amendments of the private international law” concept.

Authors of the concept underline that the current legislative lacks cause a situation when the courts show a “apropos” attitude towards this law.

“Having a nice law is an important but not fully-comprehensive aspect of the issue, we should also illustrate and speak up on this. Trainings are envisaged for advocates and professional circles”, said Mr. Haykyants adding that the inert attitude of courts towards this law comes from the complex nature of the institute.

According to our interlocutor, advocates can improve the situation: “Advocates have much work to do, if they professionally alarm and speak up on the issue in the higher instances, the lower circuits will move on”.
