Why did the Judge find that the Driver’s Guilt was not proved?

Advocate Nikolay Baghdasaryan, the defender of actor Vardan Petrosyan’s rights wrote in his Facebook account:

“The Administrative Court (presiding Judge Gevorg Sosyan), has granted my application to abolish (invalidate) the 02.10.2014 Decision AT 015562 of the RA Road Police on the Case of Administrative Violation, according to which I was subjected to administrative liability for the use of mobile phone while driving a car. Judge Gevorg Sosyan, grounded his decision with a reasoning that there are two evidences: the police protocol according to which the phone was in my hand and the second – my explanation, where I mentioned that I was using the loudspeaker. Under this circumstance the judge found that my guilt was not proven (guided by presumption of innocence). Whereas Judge Mkrtchyan in Vardan Petrosyan’s case, where there was not any evidence that my client was speaking on the phone at the moment of the accident had come to a contrary conclusion (guided by presumption of guilt). I think that in Armenia one day must be declared as a “Day of Respect of Presumption of Innocence”, so that the judges do not forget about its existence.”
