The 80-Year Old Shoemaker was declared Guilty in the Burning of the $ 9 million worth Car

The 80-year old shoemaker Harutyun Avsharyan was declared guilty in unintentionally damaging the property of another person. As a punishment Court of General Jurisdiction of Kentron and Nork-Marash Administrative Districts, presiding judge Mesrop Makyan ordered him to pay 300,000 AMD as punishment and 153,000 AMD as a judicial expense.

This verdict already entered into force. The accused and his lawyer appealed against the verdict in the Court of Appeals, demanding to annul the verdict of the First Instance Court justifying Harutyun Avsharyan or to start a new investigation. But the Court of Appeals decliined the protests. The Court of Cassation refused to accept the case.

Everything started when the 80-year old man was making his living by repairing shoes in his booth in 13 Amiryan street in Yerevan. According to the materials of the case, yet in unclear conditions there was a short circuit current as a result of the touch of the wires connected to fuses of the booth. This was the consequence of the man’s reckless treatment with the operation of the electric wires that had been illegally installed in the booth.

As a result, on 15March, 2013, at 5:30, there was fire in the booth, which burnt it and also the right part of the “KIA” car parked next to it was essentially damaged. The car belonged to Lion Barbaryan, and the fire caused him a large-scale property damage of 9.100.000 AMD.

Iravaban.net learned from Lyudvik Davtyan, the representative of the victim, that Lion Barbaryan had applied to the Court of First Instance of Shengavit Community demanding a compensation of the damage. But the Court under the presiding judge Ara Kubanyan had stopped the case till the end of the aforementioned criminal case. The lawyer also informed that the civil case has not started yet.
