The Government reduced the Charge for Will

During the last week’s Government Sessions Prime Minister Hovik Abrahamyan instructed the TA Minister of Justice Hovhannes Manukyan to reduce the fee for notary services when introducing the next legislative changes.

He said that the 25 February 2014 decision SDO -1140 of the RA Constitutional Court had provided that the application to annul the will has the features of one-side transaction and thus there was uncertainty regarding the fee.

According to Mr. Mkrtchyan the draft proposes setting the fee of 1000 AMD for the mentioned transaction and as a result the uncertain fees will be changed and the tariff for the specific action will be clear.

The government’s draft states that not clear legal settlement in practice may cause different coefficients to calculate the fee by different notaries public for the same transaction. As a result the legislative requirement of equal conditions for the same notraioal transaction for everyone may be violated. The proposed draft suggested annulling the 25 April 2002 N 919 Decision of the RA Government on the approval of the fees for notary services and to amend Decision N-733 by adding the clause which provides a coefficient tariff for the transaction as a one side notary action.
