The citizen was urged to admit the fact of illegally keeping a substantial amount of drugs which in reality did not belong to him

According to the alarm raised by the citizen Noreta E., a criminal case has been launched with regard to the seemingly abuse of the official powers of the officials based on the materials prepared by the Home Security Administration of the Police of the Republic of Armenia in the Special Investigation Service of the Republic of Armenia in accordance with Part 2 of Article 308 of the Criminal Code of the Republic of Armenia.

According to the prepared materials, within “Cannabis-Poppy 2014” complex operative preventing measures, individual officials of Martuni Police Department of the Republic of Armenia, having no negative sign in the area monitored by them, out of their personal motives, used their employment-related duties their employment interests. In particular, on August 8, 2014 at 15:00 they detained Sevada H. on suspicion of keeping and using drugs. Then they persuaded and urged him to admit the fact of illegally keeping a substantial amount of “Marijuana” drug which in reality did not belong to him. As a result, an essential damage was caused both to the rights of Sevada H. and the legal interests of the state.

Sevada H., who was presumably innocent of illegally keeping the drug with no intention of selling it, was held criminally liable. He was charged for committing a crime in accordance with part 1 of Article 268 of the Criminal Code of the Republic of Armenia. Later, the Court of First Instance of General Jurisdiction of Gegharkunik region of the Republic of Armenia sentenced him to one year of imprisonment.

A preliminary investigation is in process.

Note: The suspect or the accused of the alleged offence is deemed innocent unless his or her innocence is proved by virtue of the effective court verdict in the manner prescribed by the Criminal Procedure Code of the Republic of Armenia.
