On the decision of the Prosecutor of Investigation Department of Especially Important Cases at the RA Prosecutor General’s Office, the decision of Special Investigation Service on dismissal of the criminal case on abuse of official authorities of the Head of Investigation Department of Shengavit Administrative District and the Investigator of the same Department initiated under the provisions of Part 1 of Article 308 of the RA Criminal Code has been annulled.
As a result of investigation of the materials of criminal cases under the consideration of the Special Investigation Service by the Investigation Department of Especially Important Cases at the RA Prosecutor General’s Office, it was set that the combination of the evidence obtained in the framework of the criminal case provide grounds for involvement as accused the S. Mkrtchyan, the Head of Investigation Department of Shengavit Administrative District and H Manukyan, the Investigator of the same Department.
Performing of a criminal act under the provisions of Part 1 of Article 315 of the RA Criminal Code: “Failure to execute one’s duties properly, or improper implementation of one’s duties, as a result of negligence or bad faith of a public servant, which inflicted essential damage to citizens, organizations, public or state interests or legal rights” is attributed to S. Mkrtchyan, the Head of Investigation Department of Shengavit Administrative District and H Manukyan, the Investigator of the same Department.
Prosecutor of Investigation Department of Especially Important Cases at the RA Prosecutor General’s Office has made a decision to involve S. Mkrtchyan, the Head of Investigation Department of Shengavit Administrative District and H Manukyan, the Investigator of the same Department as defendants in the case under the requirements of Part 1 of Article 315 of the RA Criminal Code. The decision has been sent to the body implementing criminal proceeding to file an indictment to S. Mkrtchyan and H. Manukyan in accordance to the provisions of Article 203 of the RA.
