What is the procedure of payment for services of court decision enforcement agency? 

 

Dear reader,

 

According to RA law on “Court decision enforcement agency”, the services of the agency are perfomed at the expense of state budget and internal fun of the agency.

The operation expenditures are cared for at the expense of the debtee:

a) in case of property demands, it is 100,000 AMD or more, while in case of submitting property – 5% of the property value.

b) In case of 100,000 AMD worth operation and non-property operations – 5,000 AMD.

Note that alimony, salary and life and health damage related retribution envisages no expenditures.

Retribution for the service of the agency is performed by the agency decision. If non-property related operation exceeds the cost of 5,000 AMD, the retribution is made at the expense of the debtee.

If the execution results in meeting the demand of the applying party, then the factual expenditures are covered by the demanding party through court order. The payable part cannot be less thn 1% of the retributed sum. And if the retribution is dismissed at the initiative of the applying party, then the agency expenditures are covered by the demaning party. If the operation was dismissed due to bankruptcy of the applying party, then the agency expenditures are covered by the debtee in accordance to bankruptcy law. These expenditures are cared in line with court expenditures.
