The Ministry of Justice to review the List of Liquidated NGOs

“The Ministry of Justice shall review the “RA Law on Liquidation of Organizations which did not submit Tax Reports as of January 1, 2008 and removing Private Entrepreneurs from State Registration,” and restore the legal status of juridical person,” Edmon Marukyan, Independent MP said during the conversation with Iravaban.net.

“The NGOs shall not be identified in line with other organizations, individual entrepreneurs, and LLCs on the assumption of the fact that the liberty associations is not about the entrepreneurship,” the MP added
.
Recently around 10 organizations that were liquidated applied to Mr. Marukyan, with request to consider the issue of their liquidation in the National Assembly. He also noted that this number was growing (According to the Hrayr Tovmasyan, report the number of liquidated NGOs is around 600-700).

Mr. Marukyan referred to Article 20 (3) of the Law of the Republic of Armenia on Public Organizations, which provides: “Only the court may adopt a decision on compulsory dissolution of a public organization, at the request of the state authorized body and only at the presence of grounds stipulated by the law.” He noted that Agency of State Register of the Legal Persons under the Ministry of Justice of the RA violated the law by its action.

According to the MP the RA Law on Legal Acts may also be referred to. Mr. Marukyan mentioned that neither of the liquidated NGOs had received written notifications on their liquidation. The Minister only stated that the list of liquidated NGOs was posted in azdarar.am website. According to Mr. Marukyan the NGOs are not obliged to visit this website on daily basis to find out whether some information on them might have been posted there.

After raising the issue in the RA Parliament, the MP passed the list of the NGOs that applied to him to the Minister of Justice of the RA. The Minister promised to review the list again. The MP noted that it is not excluded that the taxation bodies could have provided wrong information to the Agency of State Register of the Legal Persons.

Mr. Marukyan thinks that if the case shall be submitted to the ECtHR, the Republic of Armenia shall be defeated on the assumption of precedents referring to the freedom to establish associations that ECtHR had.
